Welcome to Diving Atlantis Tenerife (referred to as "we," "us," or "our"). These Terms and Conditions govern all bookings, online reservations, course enrollments, and purchases made via our website www.divingatlantis-tenerife.com or directly at our dive center in Los Cristianos, Tenerife, Spain.
By booking a dive, excursion, snorkeling tour, or training course with us, you (the "Customer," "Diver," or "Participant") explicitly agree to be bound by the terms outlined below.
1. Bookings, Payments, and Discounts

Online Reservations: To secure a booking online, customers must pay the required deposit or full balance as indicated during the checkout process.

10% Online Booking Discount: The advertised 10% online discount applies exclusively to reservations fully processed and booked directly through our official website portal prior to arriving at the dive center.

Booking Confirmation: A booking is only considered finalized once you receive an official confirmation email containing your scheduled dates and times from Diving Atlantis.
2. Cancellation and Refund Policy
We operate small-group excursions and boat charters with strictly limited spaces. When you book a slot, it prevents others from participating. Therefore, we enforce a strict cancellation window:

Cancellation 24 Hours or Earlier: If you cancel your reservation 24 hours or more before the scheduled start time of your tour or course, you are entitled to a 50% refund of the total amount paid.

Cancellation Less Than 24 Hours: If you cancel your reservation less than 24 hours before the scheduled start time, or if you fail to show up (No-Show), you are entitled to a 0% refund (no refund will be issued).

Late Arrivals: Our boats and logistics operate on tight maritime schedules. If you arrive late and miss the departure or pre-dive safety briefings, it will be treated as a late cancellation, and no refund or free rescheduling will be provided.
3. Cancellations by Diving Atlantis (Weather & Safety)
Scuba diving and ocean boat excursions are strictly dependent on environmental conditions.

Safety Discretion: The captain or lead instructor reserves the absolute right to cancel or alter a dive trip due to adverse weather, strong currents, low visibility, or force majeure.

Alternative Options: In the event that we must cancel your trip for safety or weather reasons, we will offer you:

The option to reschedule your activity to another day or time completely free of charge.

An alternative activity that is sheltered and safe.

A full (100%) refund of the amount paid for the cancelled portion of the activity if rescheduling is impossible.

4. Health, Fitness, and Medical Clearances

The PADI Medical Questionnaire: Scuba diving is a physically demanding activity. All participants in in-water training or diving excursions must complete a standard PADI Medical Statement prior to entering the water.

Physician Approval: If you answer "Yes" to any medical condition on the questionnaire (e.g., asthma, cardiovascular issues, epilepsy), you must provide a signed medical clearance certificate from a physician stating you are fit to dive.

Refusal of Service: If you are unable to participate because you failed to disclose a medical condition or cannot provide a required physician’s sign-off, our standard 24-hour cancellation policy applies, and no refund will be issued.
5. Certification and Flying After Diving

Proof of Certification: Certified divers must present proof of their diving credentials (digital or physical C-card) and logbook verification before being allowed to participate in guided ocean dives.

No-Fly Window: It is your responsibility to manage your travel logistics. You must ensure you have a minimum 18-to-24 hour window between your last dive and your flight departure time. We will not be held liable for missed flights or dives cancelled due to a user's failure to check flight times.
6. Rental Gear and Customer Responsibility

Gear Care: When renting equipment from Diving Atlantis, you accept responsibility for keeping it in good condition.

Damage or Loss: In the event of malicious misuse, severe negligence, or loss of equipment assigned to you (e.g., dropping a dive computer or losing a mask in the ocean due to carelessness), we reserve the right to charge a fee equivalent to the replacement or repair cost of the item.
7. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Spain and the regional regulations of the Canary Islands. Any disputes arising from transactions or activities with Diving Atlantis Tenerife shall be subject to the exclusive jurisdiction of the competent courts in Arona/Tenerife, Spain.
